How long does OWCP reconsideration take? ›

ANSWER: The Board decides most appeals within 7 to 9 months from the date the case record is received from OWCP. The complexity of the issue(s) on appeal or a request for oral argument may affect the length of time it takes to decide an appeal.

OWCP pays compensation at 66 2/3% of your pay rate (if you have no eligible dependents) or at 75% (if you have at least one eligible dependent), while official leave is paid at 100% of your pay rate.

Your time on OWCP will count as creditable years of service towards your retirement. This is a major benefit as we see a lot of federal employees utilizing OWCP benefits before switching over to Federal Disability Retirement.

Subject to the exceptions expressly provided in the Act and regulations, the claimant bears the burden of providing OWCP with all written medical documentation, contemporaneous records, or other records and documents necessary to establish any and all claim criteria.

The DWP does not have a deadline for doing the Mandatory Reconsideration. Some reconsiderations take two weeks, some take several months. If you have not received your Mandatory Reconsideration Notice, it is a good idea to call the DWP after: 2 weeks to check they have logged your Mandatory Reconsideration.

PPI ratings are ordinarily measured as a percentage of the body as a whole. So, someone with a back injury and a 7% PPI rating is said to have a 7% permanent partial impairment to the body as a whole.

According to the AMA Guides, impairments that are to be rated are permanent impairments. A permanent impairment is defined as one that has reached maximum medical improvement (MMI) and is well stabilized and unlikely to change substantially in the next year with or without medical treatment.

The amount a schedule award pays will vary based on your assigned impairment rating from your doctor. This lump-sum payment is based on the OWCP Comp Rate, multiplied by the number of weeks of pay for the injured body part in the OWCP schedule, multiplied by the percentage of impairment to the injured body part.

Can I collect OWCP and Social Security at the same time? ›

You can receive and be approved for OWCP Federal Workers' Compensation and Social Security Disability at the same time. However, there will be an offset between these two benefits. You can only receive up to 80% of your pay from both benefits combined.

Schedule awards are paid for a certain number of weeks, calculated by multiplying the percentage of impairment of a body part (determined by the rating physician) times the number of weeks set out in the schedule in the FECA for that body part.
